Insurance companies seem to be doing whatever they want to do. The Indiana work comp laws do not allow the insurance company, legally, to suspend your benefits and/or workers’ compensation weekly wages simply because you miss a therapy or other doctor's appointment.
Under Indiana Code§22-3-3-4(c) if you refuse to accept offered medical treatment, your entitlement to benefits can be suspended during the period of refusal. However, before the suspension can occur, the employee must be served with a notice setting forth the consequences of the refusal, and the form must be in a form published by the Indiana Worker’s Compensation Board.
If your benefits are improperly suspended, please contact one of our attorneys at Klezmer Maudlin PC and we can help. Do not let the insurance company get away with violating the law.
